The Department of Criminal Justice Training has been appointed by the Kentucky Justice and Public Safety Cabinet as the approving authority for all law enforcement agencies sexual assault policy as required by Senate Bill 63. This law mandates that all Kentucky law enforcement agencies adopt a policy relating to sexual assault investigations. Failure to adopt a policy by January 1, 2017 will cause your agency to lose eligibility for KLEFPF.
The first four files below will assist your department implementing a policy, if needed. The first is a letter from our Assistant General Counsel Deaidra Douglas detailing the mandate, the procedures on how to submit your policy and contact information if questions arise. The second file is an instruction sheet, if your agency chooses to adopt the Sexual Assault Response Team Model Policy, on how to customize the policy. You are not required to adopt this particular policy, but all policies must meet certain statutory requirements. Thirdly, is the SART Model Policy. Lastly, is a signature sheet that the law enforcement agency head must sign and date and return to DOCJT.
For DOCJT to have ample time to review and approve each agency’s policy, we ask that your agency submit your adopted policy no later than December 1, 2016 to DOCJT.ModelPolicy@ky.gov.
